Estas fallas, tanto justificadas como injustificadas, generaron un incumplimiento de la Ley del Consumidor, ya que la empresa no aplicó los descuentos e indemnizaciones correspondientes.Esto motivó al Sernac iniciar un Procedimiento Voluntario Colectivo para exigir compensaciones adecuadas a los consumidores perjudicados. ¿Qué son los Procedimientos Voluntarios Colectivos?Los Procedimientos Voluntarios Colectivos (PVC) son una herramienta extrajudicial creada en la Ley del Consumidor, con la que el SERNAC puede negociar soluciones rápidas y eficaces para los problemas de los consumidores. Este proceso establece un plazo inicial de tres meses, que puede extenderse a seis si se logran avances significativos y la empresa involucrada colabora. En este caso, Mundo Pacífico decidió unirse al proceso, lo que da esperanza para una resolución eficiente.Regiones con más consumidores afectadosAunque el impacto fue nacional, el Sernac indicó que las regiones con mayor cantidad de afectados por estas interrupciones fueron Biobío, Metropolitana, La Araucanía, Valparaíso y Maule. Para estos consumidores, la compensación podría ser una realidad si el acuerdo avanza según lo previsto, lo que representa un paso hacia la justicia para quienes han visto interrumpido su servicio.¿Cómo se compensará a los clientes afectados?El Sernac exige tres puntos clave en beneficio de los usuarios:Reembolsos automáticos y compensaciones: Mundo Pacífico debe garantizar el pago automático de compensaciones a los consumidores afectados por las interrupciones de servicio.Cese de prácticas infractoras: La empresa debe asegurar el fin de las conductas que vulneran los derechos de los consumidores, especialmente en lo que respecta a interrupciones y falta de compensación.Mejoras en el servicio: Mundo Pacífico debe comprometerse a mejorar la calidad y continuidad del servicio para evitar futuras interrupciones que perjudiquen a los usuarios.El director nacional del Sernac, Andrés Herrera, destacó la importancia de que la empresa haya aceptado el PVC. “Permite avanzar en una solución expedita y acorde a los derechos de los consumidores, con medidas concretas como la entrega de compensaciones”, dijo. ¿Cuándo se recibirán las compensaciones?Aunque el acuerdo está en marcha, aún falta la finalización del Procedimiento Voluntario Colectivo para determinar cuándo y cómo se entregarán los reembolsos.
